Alec Baldwin may avoid prison for Halyna Hutchins’ murder on ‘Rust’ filming

In the last few hours there has been a new unexpected twist in the Halyna Hutchins murder case.

The cinematographer died as a result of an accidental discharge of a gun fired at her by the actor Alec Baldwin during the shooting of a movie scene.

The film star was initially sentenced to prison, but may not serve any jail time due to an after-the-fact rule.

According to TMZ, the Santa Fe County District Attorney has dropped a key charge in the Alec Baldwin case.

Now, if the actor is finally convicted, he might not even have to spend a single day in prison.

New Mexico law that could save Alec Baldwin

The magistrate has dropped the star’s gun charge in the case after Baldwin‘s defense filed a motion, claiming that prosecutors have used a law against the actor that does not apply.

The celebrity website reported a few weeks ago that Alec Baldwin had been charged with involuntary manslaughter in the death of Halyna Hutchins.

Initially, the prosecutor charged him with the use of the gun. Here comes the twist in the plot, as New Mexico law states that a gun charge can only apply if the weapon is ‘brandished’, that is, “if the weapon has been displayed with the intent to intimidate or injure a person”, according to TMZ.

Obviously, this law does not apply to Baldwin, as the actor did not ‘brandish’ the weapon. he was merely using it as part of the acting scene.

What is surprising, however, is that this amendment to the law was not enacted until seven months after Halyna Hutchins‘ death.

Alec Baldwin can get parole

The prosecutor dropped the gun charge against Alec Baldwin, and this is important because, had the charge been upheld, the actor could have spent a minimum of five years in prison.

Now that the charge has been dropped, if Alec Baldwin is retried for manslaughter, he would only face a maximum of 18 months in prison.

The judge may even reduce his sentence and give him probation if New Mexico law applies.

The film’s weapons officer, Hannah Gutierrez-Reed, has also ensured that this specific charge was dropped.
